Newtown Square, Pa.-based Sunoco Logistics Partners LP said on July 14 that Pennsylvania’s Commonwealth Court affirmed a lower court decision that Sunoco Pipeline LP’s Mariner East 2 pipeline project provides a public service to Pennsylvanians; and that Sunoco Pipeline is a public utility corporation, as determined by the Pennsylvania Public Utility Commission.
Sunoco Logistics added that the court further ruled that Sunoco Pipeline has the right to exercise the power of eminent domain, as authorized by Pennsylvania law.
The court's decision reaffirmed every decision by lower courts across Pennsylvania as to Sunoco Pipeline’s status as a public utility corporation.
